However, occupancy is regulated under the deed restriction and the Vail InDEED program. The property must be continuously occupied as the primary residence by at least one Qualified Resident, as defined in the deed restriction. A Qualified Resident is someone who works full-time for a legitimate business in Eagle County or is recently retired after meeting that requirement. Annual verification of eligibility is required. The deed restriction does not impose an appreciation cap and remains in effect for all future sales of the property. There is no selection process or housing lottery for this property.
